French proposal for 100% inheritance tax above 12 million euros, Digi Mart USA News (France): Charlotte Le Conte, a doctor of private law, wrote this analysis of a proposal from La France insoumise to tax inheritances above 12 million euros at 100%. The article was reviewed by Jean-Paul Markus, a professor of public law at the Université Paris-Saclay.
The Constitutional Council has already struck down taxes with a marginal rate of 75%. A 100% inheritance bracket would therefore have very little chance of passing its review, according to the article.
Presenting the budget component of La France insoumise’s program, Éric Coquerel said: “It’s simple, above 12 million euros, we take everything.” He described taxing successions at 100% above that threshold as a “question of republican principle,” aimed at preventing the formation of what he called a “money nobility.”
The proposal is not new. Jean-Luc Mélenchon formulated nearly the same wording in January 2022, when he was a candidate in the presidential election: beyond 12 million in inherited wealth, “I take everything.” Manuel Bompard took it up again in June 2024 under the term “maximum inheritance.” On each occasion, the article notes, the measure was concluded to face the Constitutional Council, with the same causes producing the same effects.
