French family reunification alternative family accompanying procedure talent residence card, Digi Mart USA News: Family reunification is not the only legal route allowing a foreign national to bring a spouse and children to France. In an Instagram video, lawyer Indiara Fazolo presents the “accompanying family” procedure, available under certain conditions and linked in particular to the talent residence card.

Under the general family reunification rules, the applicant must generally have resided legally in France for at least 18 months. Fazolo explains that certain categories of foreign nationals can bring their family without waiting that period, using a procedure specifically designed for them.

The accompanying family route allows the spouse and minor children of a talent card holder to join them.

According to Service-Public, the official French government information portal, the 18-month requirement is a minimum prior residence period, not a guaranteed processing time. The classic procedure mainly concerns the spouse and minor children of the applicant, while holders of certain professional statuses may use a different scheme.

Eligibility depends on the residence permit held and on meeting the professional and income-related criteria that apply to that category.

The talent card covers several categories of foreign nationals, including qualified professionals, researchers and certain project holders. A high salary alone does not guarantee a talent card.

Under Article L.421-22 of the CESEDA, the French immigration code, the adult spouse of certain holders may obtain a permit bearing the mention “talent-famille,” and the arrangement also applies to the couple’s children under the conditions set by regulation.

Fazolo says the procedure can allow a family to prepare a joint move to France rather than waiting for one member to meet the classic requirements. However, this does not mean all family members can travel without formalities.

They must obtain the appropriate visas from the competent French consular authorities, and the verification of family ties and examination of applications remain necessary. No provision guarantees immediate acceptance or a fixed date of arrival.

Algerian nationals residing in France follow a special regime organized in particular by the Franco-Algerian agreement of December 27, 1968. Under that agreement, the minimum prior residence period for classic family reunification is in principle one year for Algerian nationals holding a residence certificate meeting the applicable conditions, rather than 18 months.

Service-Public also notes that an Algerian holder of a one-year residence certificate bearing the mention “scientifique” may, under certain conditions, use the simplified accompanying family procedure.

The procedure described by Fazolo is a legal alternative for foreign nationals who meet the conditions of a status that opens entitlement to accompanying family. It does not allow applicants to bypass the requirements applying to those who fall exclusively under the classic procedure.

Before applying, individuals should identify the applicable residence permit, the professional or family conditions to be met and the consular formalities required. Lawyers specializing in immigration law can help determine whether a person falls under family reunification or another scheme provided by law.
