Inés Gómez Mont, Digi Mart USA News: Former television host Inés Gómez Mont has filed a habeas corpus petition in federal court following her arrest in the United States, challenging her immigration detention and seeking to avoid being moved out of Miami, where she has lived for the past several years.
Local media reported that her legal team filed an emergency petition on Halloween requesting that immigration authorities be prevented from transferring her to another detention center while her legal status is being clarified.
Federal judge Jeffrey Kuntz of the U.S. District Court for the Southern District of Florida ordered U.S.
Immigration and Customs Enforcement (ICE) to justify the grounds for her arrest and explain why she remains in custody. Authorities have until Wednesday, November 4, to respond to the petition.
Kuntz declined to grant an immediate stay that would have halted her transfer. He noted, however, that courts do not have the authority to prevent ICE from moving detainees to other districts.
The petition also cites a claimed medical treatment received by one of her daughters as the reason she needs to remain residing in Miami.
