CAF recovery of housing aid from Algerian national using Air Algérie and Transavia flight data, Digi Mart USA News (Rhône, France): The Caisse d’allocations familiales (CAF) of France has demanded that an Algerian national repay more than €4,000 in personalized housing aid (APL), citing several extended stays in Algeria.
The CAF of Rhône made the demand on March 13, 2025, seeking €4,225.17 in housing aid it said was overpaid for the period from January 2022 to October 2023. To prove the trips, the agency relied on passport stamps and information provided by the airlines Air Algérie and Transavia, a procedure permitted under French law.
The beneficiary challenged the decision before the administrative court, requesting annulment of the decision, relief from the obligation to repay, the return of sums already recovered, and €1,200 in court costs.
In its defense, the CAF argued that the beneficiary no longer met the conditions for receiving APL because he had made several prolonged stays in Algeria, some lasting a year, between September 2021 and October 28, 2023. The court’s ruling, issued on October 30, also referred to a stay in Algeria between March and April 2024, which was considered in the investigation but falls outside the period of the claimed overpayment.
Both airlines confirmed that the applicant was aboard flights to Algeria on the dates cited in the investigation. Under APL rules, the court noted that the dwelling must be effectively occupied by the beneficiary, their spouse or a dependent for at least eight months a year, subject to exceptions.
Based on this evidence, the court rejected the applicant’s appeal and all his other requests. He must therefore pay the €4,225.17 demanded by the CAF.
