Social work forensic reports in Mexican courts, Digi Mart USA News (Mexico): Forensic social work reports are a technical and scientific assessment carried out by a specialized professional to advise judges and courts in legal proceedings. The report provides an objective opinion on the social reality of a person or family.
During a broadcast of La Voz Judicial, hosted by Rosalía Buaun and Lino Calderón, the guest was Dr. Rosalinda De León, Magistrate of the Second Family Chamber.
She said it is important for justice to have a social perspective, not only a purely legal one, and to consider the many circumstances that shape a human being.
According to De León, the forensic work in social work includes a personal interview with the individual, a visit to the person’s home, photographs of the residence, and the delivery of documents that will support the expert opinion. Social work forensic reports and environmental reports are conducted at the home previously designated by the judicial authority.
If the person is institutionalized, the assessment takes place at that facility.
In criminal matters, forensic social work assessments are carried out at the center where the person deprived of liberty is held, or at the home previously designated by the judicial authority. To undergo a forensic social work assessment, a person must present an official identification and proof of address dated no more than three months earlier, which must correspond to their current residence.
The services are completely free of charge and include a socioeconomic study.
De León said the service is personal. If the person summoned cannot attend, only the legal representative authorized by the judge may be attended to, provided the judge has not revoked that authorization in writing.
To prepare the report, the expert conducts an exhaustive social investigation to obtain objective and precise information through an in-depth examination of the problem. De León said these expert opinions are, or should be, independent and objective, and that the social assessment must not be influenced even by the party that hired the expert.
It should include in-depth interviews with the individual, interviews with family members, an analysis of the socio-labor environment, employment records, and similar material. Ultimately, it should describe the person and their situation, as well as the expert’s conclusions.
A social assessment by a court-appointed expert or an independent professional allows the evaluation of social harm, to identify and locate means to mitigate the damage that a particular event or problem may cause to the social well-being of an individual, group, or community.
Social forensic assessments are also based on existing civil and criminal procedures. Drawing on the legal framework set out in Mexican legislation, these assessments can address areas such as divorce or separation, guardianship of minors and adoption, disability, dependency, workplace accidents, traffic accidents, mortgage debt, and gender-based violence.
De León added that a social forensic opinion is required when a judge needs knowledge of the social reality of a person, which has a major influence on many other contextual aspects of the individual.
The purpose of the social forensic assessment is to evaluate the social factors that may affect a person, allowing the court to understand that person’s context and how it has evolved over time. It reveals information about family, social, cultural, economic, employment, housing, and educational aspects.
Because this information is essential for a judge to issue a fair and appropriate ruling, the social forensic report typically includes three main parts:
First, a social study that sets out all the information gathered during the investigation. Second, a forensic interpretation that includes the diagnosis of the situation and the expert’s conclusions.
Third, recommendations, where the expert may propose measures to improve the person’s social situation.
Finally, forensic social work reports can serve many purposes, depending on the type of assessment and its objective. They are mainly conducted to help and to provide a range of uses according to the case in which they are applied.
